By initiating a commission request with Cardycraft, you ("Client") agree to be bound by these Terms and Conditions. Please read them carefully before submitting your commission request.
Acceptance of Terms
By clicking "Start Commission Form" or submitting any commission request through our Discord bot or other communication channels, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy.
Commission Process
Request Submission
- All commission requests must be submitted through our official channels (Discord bot, direct message, or email).
- Providing accurate and complete information is the Client's responsibility.
- Cardycraft reserves the right to decline any commission request for any reason.
Quote and Payment
- A price quote will be provided based on project specifications after the commission form is completed.
- Quotes are estimates and may be adjusted if project scope changes.
- Payment terms will be discussed and agreed upon before work begins.
Accepted Payment Methods
Cardycraft accepts the following payment methods:
- Wise (Recommended): Quote prices are based on Wise transfers with no additional fees.
Example: If the quoted price is $100 USD:
- Payment via Wise: $100 USD
The surcharge will be clearly indicated in the final invoice.
Payment Schedule
- Deposit: A non-refundable deposit of 50% is required before work begins.
- Final Payment: The remaining 50% is due upon project completion before final delivery.
Project Timeline
Estimated Completion
- Project timelines are estimates and may vary based on complexity and workload.
- Delays caused by incomplete information or scope changes may extend the timeline.
- Cardycraft will make reasonable efforts to meet agreed-upon deadlines.
Rush Orders
- Rush orders may be accommodated for an additional fee (typically 25-50% premium).
- Rush order availability is not guaranteed and depends on current workload.
Revisions and Changes
Included Revisions
- Each commission includes up to 2 rounds of reasonable revisions.
- Revisions must be requested within 7 days of receiving the deliverable.
- Major scope changes are not considered revisions and may incur additional charges.
Additional Revisions
- Revisions beyond the included amount will be charged at an hourly rate.
- Significant changes to project scope will require a new quote.
Intellectual Property and Usage Rights
Personal Use Commissions
- Client receives a non-exclusive license to use the commissioned work for personal, non-commercial purposes.
- Cardycraft retains full ownership and copyright of the work.
- Client may not resell, redistribute, or use the work for commercial purposes.
Commercial Use Commissions
- Client receives a limited commercial license to use the commissioned work as specified in the agreement.
- Cardycraft retains copyright but grants usage rights according to the license.
- Specific usage rights and restrictions will be outlined in the commercial agreement.
Portfolio Usage
- Cardycraft reserves the right to display commissioned work in portfolios, social media, and promotional materials.
- Client confidentiality requests will be honored if specified before project completion.
Delivery and File Format
Delivery Method
- Completed projects will be delivered via Discord, email, or file transfer service.
- Minecraft map files will be provided in the format specified (e.g., world folder, schematic file).
File Storage
- Client is responsible for downloading and backing up delivered files.
- Cardycraft is not responsible for file storage beyond 30 days after delivery.
Refunds and Cancellations
Client Cancellations
- Deposits are non-refundable once work has begun.
- If Client cancels after work has begun, payment for completed work is required based on project progress.
Cardycraft Cancellations
- If Cardycraft cancels a project, a full refund will be issued.
- Partially completed work may be provided at Cardycraft's discretion.
Refund Policy
- Refunds are not provided for completed work that meets the agreed-upon specifications.
- Technical issues with delivered files will be addressed at no additional charge.
Store Purchases & Subscriptions
No Refunds
- All store purchases (maps, bundles) and subscription payments are final. No refunds will be issued.
Automatic Renewal
- Subscriptions (Gold, Diamond, Netherite) renew automatically at the end of each billing cycle.
- You will be charged the applicable subscription fee until you cancel.
How to Cancel Your Subscription
To stop future charges, you must cancel your subscription before the next billing cycle through one of the following methods:
- Website: Go to your account settings → Subscription → Cancel subscription.
- Patreon: If you subscribed via Patreon, cancel your pledge directly at patreon.com.
- Discord: If you subscribed via Discord, manage your subscription in Discord → Server Settings → Subscriptions.
Account Deletion Does Not Cancel Subscriptions
- Deleting your CardyCraft account does not automatically cancel your subscription.
- If you delete your account without cancelling your subscription first, charges will continue. You must cancel through the methods listed above before deleting your account.
Client Responsibilities
The Client agrees to:
- Provide accurate and complete project information.
- Respond to communications in a timely manner.
- Review deliverables and provide feedback within agreed timelines.
- Make payments according to the agreed schedule.
- Not use the work in ways that violate applicable laws or third-party rights.
Cardycraft Responsibilities
Cardycraft agrees to:
- Deliver work that meets the specifications outlined in the commission agreement.
- Communicate project progress and any potential delays.
- Provide the agreed-upon number of revisions.
- Maintain confidentiality of Client information as outlined in the Privacy Policy.
Limitation of Liability
No Warranties
- Commissioned work is provided "as-is" without warranties of any kind.
- Cardycraft does not guarantee that Minecraft maps will be compatible with future game updates.
Liability Limit
- Cardycraft's total liability shall not exceed the total amount paid by Client for the specific commission.
- Cardycraft is not liable for indirect, incidental, or consequential damages.
Dispute Resolution
Communication
- Any disputes should first be communicated directly to Cardycraft for resolution.
- Good faith efforts will be made to resolve issues amicably.
Mediation
- If direct communication fails, parties agree to attempt mediation before pursuing legal action.
Prohibited Uses
Client agrees not to:
- Use commissioned work to create illegal, harmful, or offensive content.
- Claim commissioned work as their own original creation.
- Reverse-engineer or modify work in ways that violate the license agreement.
- Resell or redistribute commissioned work beyond the scope of the license.
Minecraft and Third-Party Terms
- All commissioned work complies with Minecraft's End User License Agreement (EULA) and Commercial Usage Guidelines.
- Client is responsible for ensuring their use of commissioned work complies with Minecraft's terms.
- Cardycraft is not affiliated with Mojang Studios or Microsoft.
Modifications to Terms
- Cardycraft reserves the right to modify these Terms and Conditions at any time.
- Changes will be effective immediately upon posting.
- Continued use of our services after changes constitutes acceptance of modified terms.
- Existing commissions will be governed by the terms in effect when the commission was accepted.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms and Conditions, along with the Privacy Policy and any written commission agreement, constitute the entire agreement between Client and Cardycraft.
